Agreement and Service Operator

These Terms govern use of the OliveBird Med website and the administrative services operated by Glow Med Inc. ("we," "us," or "our"), including our branded visit and patient-portal services. Read them before creating an account or purchasing services. Do not use the services if you do not agree to the applicable terms.

Bask supplies technology used by the patient platform. Neither using that technology nor contacting Glow Med Inc. creates a clinician-patient relationship with Bask or Glow Med Inc.

Our Privacy Policy, Cancellation Policy, Refund Policy, and Shipping Policy explain related practices. Clinical services also require the treating medical group's applicable terms and Consent to Telehealth. A privacy notice, consent to treatment, and authorization for recurring payment have different purposes.

Medical Care and Pharmacy Services

Glow Med Inc. does not independently diagnose, prescribe, compound, or dispense medication. Clinical decisions are made by the treating licensed healthcare professional. Prescriptions are dispensed by a licensed pharmacy where legally permitted.

Services are available only in U.S. jurisdictions where the treating provider is authorized to practice and the dispensing pharmacy is authorized to serve you. Eligibility varies by program, medication, patient location, and applicable requirements. Partner-network coverage does not mean every OliveBird Med program is available in every state. Contact contact@olivebirdmed.com before purchasing if availability for your location is unclear. We do not provide care or fulfill an order where the required authority or service availability is absent.

The clinician and medical group responsible for your care must be identified during the visit process. Ask for clarification before consenting if their identity is unclear.

Eligibility, Location, and Emergencies

The services described here are for adults aged 18 and older who meet the relevant program criteria. You must accurately disclose your identity and physical location during each encounter. Care is available only where the treating professional has authority to practice and the pharmacy is authorized to dispense.

These services are not for emergencies. Call 911 or seek emergency care when necessary. Do not rely on website forms, email, or portal messages for an urgent response.

Clinical Evaluation and Treatment

Website descriptions are general information, not personalized medical advice. A clinician may request further information, laboratory testing, a live visit, or an in-person examination. The clinician may decline treatment or recommend a different level of care.

Completing a questionnaire or making a payment does not guarantee a prescription, a particular product, a particular dose, or a health outcome. Treatment and refills remain subject to clinical review and applicable law.

Give complete and accurate health information and tell your care team about changes relevant to your treatment. Follow the clinician's and dispensing pharmacy's instructions, and use the portal for clinical questions.

Accounts and Acceptable Use

Use an account only for yourself unless an authorized representative arrangement is expressly permitted. Keep account and contact information accurate, protect your credentials, and report suspected unauthorized access.

Do not impersonate anyone, submit false medical information, attempt to obtain medication unlawfully, interfere with the services, or access another person's information. We may restrict access to address misuse or security concerns, subject to applicable duties concerning care continuity, records, and existing orders.

Prices and Payment

Review the actual checkout offer before paying. It must identify the price, included services or medication, any separate consultation or shipping charges, and whether payment is one-time or recurring. A starting price on a public page does not establish the cost of every dose or treatment plan.

Payment is processed through the patient platform. Do not send card details by email. A payment acknowledgment is not a prescription or confirmation that medication has been dispensed.

Before you authorize payment, checkout will state when payment is collected, whether a card authorization is used, and what the charge includes. Any separately charged consultation, laboratory, medication, or shipping service must be identified before purchase. Prices are in U.S. dollars unless expressly stated otherwise; applicable taxes and the total payable are disclosed before payment.

A completed consultation pays for a clinical evaluation, not a prescription. Its charge is non-refundable only if the price and non-refundable status were separately disclosed before purchase, subject to applicable law. A consultation is completed only when the clinician has performed and documented the evaluation and communicated a decision or care recommendation; intake submission or waiting for review is not completion.

If treatment is declined, medication, unused shipping, and other unprovided services are refunded. Only a completed, separately disclosed service may remain payable. If no completed-service charge was separately disclosed within a bundle, the declined bundle is refunded in full. We do not deduct undisclosed cancellation, administrative, or payment-processing fees. The Refund Policy explains cancellation before pharmacy preparation, errors, and other refund rights.

Recurring Plans and Cancellation

If you choose an automatically renewing plan, its amount, billing interval, and next renewal date, time, and time zone will be disclosed before enrollment. Your authorized payment method will be charged at that interval until you cancel. A one-time purchase does not itself authorize recurring billing. We provide a retainable acknowledgment of the renewal terms and cancellation method, and any required renewal, trial-expiration, or price-change notices.

You may cancel future renewals using Cancel future renewals and sending the prepared email, or by emailing contact@olivebirdmed.com directly. No reason, telephone call, or cancellation fee is required. A request received before the next scheduled renewal stops that renewal and later renewals, without an additional multi-day notice period. We honor the time your request was received, even if our response is sent later. Existing orders are handled separately under the Cancellation and Refund Policies.

A recurring-payment arrangement requires the applicable disclosure and affirmative authorization before charging. Stopping medication, not using the portal, or unsubscribing from marketing messages is not the same as canceling billing.

The Cancellation Policy explains how to stop future renewals and request cancellation of an existing order. The Refund Policy explains the treatment of charges, including consultations, clinician-declined treatment, and medication already dispensed. These conditions must be presented before purchase.

Fulfillment and Returns

Prescription fulfillment requires a valid prescription and pharmacy acceptance. Review the Shipping Policy for the applicable processing and delivery estimates, costs, destination restrictions, and procedures for delivery problems.

Prescription products cannot be returned to us for reuse or resale. This restriction does not eliminate remedies for dispensing errors, billing errors, non-delivery, or other circumstances protected by law. Do not send medication to Glow Med Inc.'s company address.

Electronic Communications and Consent

Service notices may be provided through the platform or contact methods you authorize. Keep your contact details current. Ordinary email and text messages may involve privacy risks; use the patient portal for sensitive information.

Agreeing to these Terms does not replace informed telehealth consent, a required health-information authorization, or a separate marketing choice. Ask the treating team to explain the clinical consent before agreeing if you have questions.

Website Content and Availability

Website text, branding, and other materials are protected by applicable intellectual-property rights. You may use the website for its intended personal purposes; these Terms do not transfer ownership of our content to you.

We aim to keep information accurate and services available, but technical interruptions and errors can occur. We will address material order or pricing errors with you rather than silently substitute a different charge or product. No provision here excludes obligations or rights that applicable law does not allow us to exclude.

To the extent permitted by law, informational website content is provided "as is" and "as available," without a promise of uninterrupted access or fitness for a particular purpose. This website-content provision does not disclaim clinical standards of care, medication quality, privacy duties, express purchase promises, refunds due, or other rights that cannot lawfully be excluded.

Concerns, Updates, and Contact

Contact us first about administrative or billing concerns. Clinical concerns should be raised with the treating medical group. You retain the right to contact a regulator, licensing board, or other appropriate authority.

Changes will be identified by the revision date. Material changes require any notice or consent required by applicable law and do not retroactively remove rights relating to an existing purchase.

If part of these Terms is unenforceable, the remaining provisions continue to apply to the extent permitted by law. A failure to enforce a provision on one occasion is not a waiver on another occasion. These Terms do not require you to waive access to a court, small-claims process, payment dispute process, or regulator.
